These Terms of Service (“Terms”) govern your use of the BreakTrace iOS application (“the App”), published by Waypoint Digital LLC, a Texas limited liability company (“Waypoint Digital,” “we,” “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What BreakTrace does

BreakTrace uses your device’s camera and LiDAR sensor to scan a putting green, estimate its slope, and suggest a putting line and pace. All readings are estimates for informational and training purposes only. Scanning accuracy depends on lighting, surface conditions, device hardware, how the scan was performed, and other factors outside our control.

2. Rules of golf and fair play

Electronic devices that measure slope or gauge a green are **restricted or prohibited during competitive rounds** under the Rules of Golf (see USGA/R&A Rule 4.3) and by many clubs, tours, and events. **You are solely responsible for knowing and following the rules that apply to your round.** BreakTrace is intended for practice, training, and casual play where such devices are permitted. We are not responsible for penalties, disqualifications, or other consequences of using the App where it is not allowed.

3. Assumption of risk

Golf is an outdoor activity. Using the App requires pointing your device at the ground and moving around a green. You are responsible for your own safety and awareness of your surroundings, including terrain, water hazards, other players, and golf balls in flight. Do not use the App while operating a golf cart or other vehicle.

4. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the App except as permitted by law.

5. Subscriptions and purchases

Some features may require a paid subscription (“BreakTrace Pro”).

  • Payment is charged to your Apple Account at confirmation of purchase.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • Manage or cancel subscriptions in your device’s Settings → Apple Account → Subscriptions. Deleting the App does not cancel a subscription.
  • If a free trial is offered, unused trial time is forfeited when you purchase a subscription.
  • Prices may change; changes apply at the next renewal after notice.
  • Refunds are handled by Apple under the App Store terms.

6. Privacy

The App processes camera and LiDAR data on your device to build the scan. Scan data is not transmitted to us. See our Privacy Policy for details on what (if any) data is collected and how it is used.

7. No warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SLOPE READINGS, PUTT LINES, OR PACE SUGGESTIONS ARE ACCURATE, RELIABLE, OR WILL IMPROVE YOUR PUTTING.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

9. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time. Sections 3, 7, 8, and 10 survive termination.

10. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by a new effective date, and continued use of the App after a change constitutes acceptance. The current version is always available in the App under Settings → Terms of Use.

Apple is not a party to these Terms and is not responsible for the App or its content. Apple’s standard Licensed Application End User License Agreement applies where these Terms are silent.
